26th VCCCDRA Annual General Membership Meeting, March 11, 2020 (including Audio Files and Handouts)

INTRODUCTORY REMARKS BY RENE G. RODRIGUEZ, PRESIDENT, VCCCDRA

VCCCDRA retirees were very fortunate to be able to hold their Annual General Meeting on March 11, 2020, at the Wright Event Center on the Ventura College campus, one day before the Ventura County Health Officer declared a local health emergency in Ventura County, and nine days before Governor Newsom declared a Stay Well At Home order for the entire State of California.

Those who attended, 104 of us, were unaccustomed to greeting each other in these worrisome coronavirus times without the usual shaking of hands or embracing each other, instead, inventing ways to show how glad we were to see each other with the minimum of distance and touching.  In spite of the unusual circumstances, the meeting proceeded fairly normally, resulting in fruitful and lengthy discussions on the matter at hand.

The focus of the meeting was on healthcare and the issues arising out of the District’s desire to push for a drastic change to our current health plans.

I asked Marie Soo Hoo, VCCCDRA Secretary, to give us a write up of the motions that were moved, seconded and passed near the conclusion of the meeting, that help to summarize what happened at the meeting.

Motions passed at Annual General Meeting – 3/11/2020

    1. Al Miller moved that the Executive Board of the Retirees’ Association be authorized to take any legal action necessary against the District to prevent them from moving to the proposed CalPERS plans. The motion was seconded by Bill Thieman.

No vote was taken and more discussion took place as there were more members who had questions or wanted to make comments regarding the issue.

Rene, you also explained that before any legal action can be taken, there must be evidence of “harm” to the group.

    1. Al Miller restated his first motion once again as follows (it had already been seconded) but I believe Lynn Fauth and several others said they seconded it also:

Al Miller moved to authorize the Executive Board to begin a campaign for a “war chest” of funds for the exploration of legal action against the District based on the proposed CalPERS plans and to file legal action against imposing an inferior benefits plan on the Retiree group.

Motion passed by a majority vote of the membership present.

    1. Ruth Hemming’s motion:

Ruth moved that the members authorize the Executive Board to act on its behalf as it sees fit regarding its benefits. Motion was seconded by Ana Maria Valle Villa.

After lengthy discussion, the motion passed by a majority vote of the membership present.

The President of Ventura College, Dr. Kim Hoffmans, attended the meeting to give retirees a very warm welcome.  She mentioned that Ventura College will be celebrating its 95th anniversary, and wanted retirees be part of it.  Anne King, Executive Director of the Ventura College Foundation will be telling us more about it.  Kim also was very gracious in wanting to welcome retirees to Ventura College in a very special way, which you can hear for yourself when you play the recording of her presentation.  Here, I must beg Kim’s pardon, and yours, for remembering to turn the digital audio recorder on while she was in the middle of her presentation.

The President of Ventura College, Dr. Kim Hoffmans, attended the meeting to give retirees a very warm welcome.  She mentioned that Ventura College will be celebrating its 95th and 100th anniversaries, and wanted retirees be part of them.  Anne King, Executive Director of the Ventura College Foundation will be telling us more about it.  Kim also was very gracious in wanting to welcome retirees to Ventura College in a very special way, by giving gifts to the first retiree who walked in the door for this meeting (MoDean McCullough), and to the person who is having a birthday near or around her birthday, May 29, and there was one retiree (Jim Merrill).  It lightened the spirits of all present and made for a very nice welcoming to Ventura College.  Thank you, Kim!

At the March 10 Board of Trustees meeting, I made a formal request of the Board that it hold a Special Meeting with the leadership of the Retirees’ Association, to allow it to present to the Board, in detail, the large discrepancies that exist between the CalPERS health plans that the District is proposing, compared to the Anthem/Blue Cross health plans.

The Chancellor, and members of the Board of Trustees, have made remarks to the Retirees’ Association leadership, that you “care” about retirees, and would never do anything to harm them.

I am stating to you now, in writing, on behalf of the Retirees’ Association, that replacing the current health plans with the proposed CalPERS health plans, WOULD BRING GREAT HARM TO TIER I AND TIER II RETIREES.

We are ready to explain to you what this great harm would be if you give us the opportunity.  If you do not wish to give us the opportunity, then we demand an explanation.  It cannot be that you already understand the differences between CalPERS plans and Anthem plans, as we understand them.  Not even CalPERS representatives could answer all of the questions we asked of them at a meeting we had on January 23.

Show us that you do want to understand why we are so opposed to the CalPERS health plans by meeting with us.  Otherwise, we will conclude that you do not care to understand how seriously the CalPERS health plans are substandard to the current Anthem plans.

Please accept the following email and appeal as the statement I would have made in open Board session in normal times:

The Retiree Association Executive Board has made an appeal to the District Board of Trustees to suspend contract negotiations in the face of government ordered curtailment of civic life due to the emergency of the spreading corona virus.

The current environment is causing unprecedented time consuming and disruptive adjustments in every aspect of the District operation and attempts to offer ongoing education for students.

It is not reasonable or possible now for the normal process of effective negotiations to move forward:
to prepare for negotiation meetings, to negotiate face-to-face, or to engage in any mutual communication
and decision making with constituencies, or with constituency memberships.

We have not received a response to our initial appeal. So we now reiterate the urgent need for the District to face up to and address the new reality of the restrictions and limitations we are
all living with.

Suspend negotiations, please.

Re:         Impending Contract and Settlement Agreement Violations

The Retirees’ Association has been notified through the grapevine that the SEIU has reached a tentative agreement with the District in contract negotiations.

Presumably, this includes accepting CalPERS as the District agent for contracting SEIU health benefits and the salary increases the District has offered in exchange.

Since SEIU actions affect retiree long standing contractual and settlement agreement rights with the District, this letter is to notify you that should the Retirees’ Association decide to sue the District for contract and/or settlement agreement violations, the SEIU Local 99 will be named a party to that lawsuit.

SUSPENDING NEGOTIATIONS While Coronavirus Crisis Persists

RE:    Suspending Negotiations While the Coronavirus Crisis Persists

The use of technology can make it possible for the Board leadership to keep in touch with itself and its constituents, but it cannot replace the dynamic interchange that has to take place for meaningful negotiations to proceed.

Retirees have a lifetime stake in the outcome of these negotiations as it pertains to their healthcare benefits, especially in the context of the growing coronavirus pandemic.

We, therefore, ask that the District and the bargaining units to consider suspending negotiations while a state of National, State, County and College District emergency exists due to the currently expanding coronavirus crisis.

Serious and meaningful discussions cannot be expected take place between the parties under these constantly changing impossible circumstances.
